घर से ऑफिस जाते समय
रास्ते में
मेरी माँ की शक्ल की
एक ओरत को
बस ने धक्का मारा

दिल्ली के झल्ली मजदूर

भारत का संविधन 'समाजवादी' है। भारतीय संविधन में दे}ा के मजदूर वर्ग के अध्किारों की सूरक्षा के लिए कई कानून बनाए गए हैं। भारतीय संविधन इनके }ाोषण की सभी गुंजाइसों को इन कानूनों के जरीए समाप्त करने की भरकस को}िा}ा की है। इसके लिए मुख्य रूप से औद्योगिक विवाद अध्निियम 1947, ट्रेड यूनियन ऐक्ट 1926 और भी कई महत्त्वपूर्ण अध्निियमों को संविधन में समय-समय पर जोड़कर, सं}ाोध्न कर मजदूरों-मेहनतक}ाों को एकजूट होने, यूनियन बनाने, संगठित होने तथा अपने हकों-अध्किारों के लिए आन्दोलन करने का अध्किार दिया गया है। दूसरी तरपफ इन कानूनों के रहते हुए एवं इन्हें लागू करने वाली संस्थाओं के रहने के बावजूद इन कानूनों को पूरी तरह लागू नहीं किया गया। मजदूरों के लिए कानून एवं मजदूरों के अध्किार उन्हीं जगहों पर लागू हो सके जहां संगठीत तौर से मजदूरों या ट्रेड यूनियनों का आन्दोलन पूरे जूझारू संघर्ष में तब्दील हुआ। लेकिन यहां भी यह तभी तक लागू रह सका जब तक मजदूर आन्दोलन चलता रहा या मजदूर वर्ग जागरूक रहा। मजदूर, ट्रेड यूनियन के आन्दोलन की ताप कम होने पर मजदूरों के हासिल किये गये अध्किारों को कारखाना मालिक-प्रबन्ध्न या संस्थान ध्रिे-ध्रिे कम करते हुए इन्हें न्यूनतम स्तर पर ले आई। सरकार के संस्थान जो इन्हें अपनी पहलकदमी पर लागू कर सकती थी/हैं, ने इन्हें अपनी पहलकदमी पर लागू करने को कभी प्राथमिकता नहीं दी। इसे हम सरकार की सोची-समझी नीति भी कह सकते हैं या उद्योगों एवं संस्थाओं के मालिकोें के प्रति सहानुभूतिपूर्ण नीति भी कह सकते हैं। क्योंकि सरकारी संस्थानों एवं कारखानों में मजदूरांे के ट्रेड यूनियनों को आज भी श्रम अध्किारों के लिए संघर्ष करना पड़ रहा है। इसके उदाहरण हमें बोकारो, दूर्गा पूर, भिलाई, राउफरकेला इस्पात कारखानों, बंदरगाहों, बैंकों, सरकारी कर्मचारियों, रेल उपक्रमों और कोयला एवं विभिन्न खदानों आदि में हम आज भी देखते हैं। मजदूरों के }ाोषण की कवायद प्राचिन काल से ही चलती रही है और मजदूर वर्ग भी इन }ाोषणों के खिलापफ हर समय संघर्ष करता रहा है और उसने अपने संघर्षों से कई विजय हासिल किये हैं। भारत में अंग्रेजों के }ाोषण-काल में म}ाीनी उद्योग आता है और भारतीय समाज में एक नया औद्योगिक मजदूर वर्ग का जन्म होता है। इन उद्योगों में उनका }ाोषण चरम पर होता है और औद्योगिक }ाांति भंग होने लगती है। तभी अंग्रेजी हुकुमत औद्योगिक }ाांति कायम करने के लिए और औद्योगिक उत्पादन }ाांतिपूर्वक चलता रहे, एक कानून बनाती है जिसके द्वारा मजदूर वर्ग अपने अध्किारों को पाने के लिए कारखाना मालिक से सामुहिक सौदेबाजी कर सके, जिसे हम ट्रेड यूनियन अध्निियम 1926 के रूप मेें जानते हैं।
महत्त्वपूर्ण बात यह है कि उस काल में विभिन्न दे}ाों में साम्राज्यवादी और उपनिवे}ाी गुलामी से मुक्ति के आन्दोलन भी अपने उफपफान पर थे और रूस में 1917 में मजदूर वर्ग ने सर्वहारा क्रांति करके मजदूरों के सोवियत की स्थापना कर ली थी। जिससे दुनिया के मजदूर वर्ग ही सिपर्फ सबक नहीं ले रहे थे बल्कि दुनिया के पूँजीपति एवं उपनिवे}ाी हुकुमत भी सबक लेे रहा था। जिसकी बजह से उस काल में दुनिया के अनेक दे}ाों में वहां का }ाासक-पूँजीपति वर्ग अपने दे}ा में मजदूरों के लिए कई अध्किारों की घोषणा मजदूर वर्ग के आन्दोलन के दबाब में कर रहे थे और उनके हितों के लिए कानून बना रहे थे। भारत में भी वह प्रभाव काम कर रहा था। मजदूर वर्ग इसके बावजूद हो रहे अपने के खिलापफ लगातार आन्दोलनरत था ताकि उसे मिले कानूनी अध्किारों को वह प्राप्त कर सके और उसे बचा सके। आजादी के बाद कुछ हद तक भारत की सरकारें भी इसे मजदूर वर्ग के दबाव में लागू करती रही। लेकिन 1980 और उसके कुछ वर्ष पहले से विदे}ाी पूँजी के साम्राज्यवादी स्वरूप का एवं भारत के पूँजीपतियों के वै}िवक विस्तार की मिली भगत ने भारत के मजदूरों पर लगाम कसने }ाुरू किये एवं निजिकरण, उदारीकरण की प्रकृया बेहद नियंत्रित गति से लागू करना }ाुरू किया। जिसमें भारत सरकार पूरी तौर पर }ाामिल रही। इन नीतियों के खुले और ठोस रूप को वर्ष 1991 में कांग्रेस के नरसिम्हा राव के नेतृत्व की सरकार ने दे}ा में घोषणा करके स्थापित कर दिया।
उदारीकरण,निजीकरण की यह बसंती बयार ने साम्राज्यवादी पूँजी और भारत के जूनिसर साम्राज्यवादी पूँजी को कापफी विस्तार दिया। जिससे इन्हें विदे}ाों में और भारत में भी इनके लिए बाजार के विस्तार की खुली प्रतियोगिता के नाम पर अतिरिक्त मुनापफे की बाढ़ का सुख मिलने लगा। लेकिन दूसरी ओर इसने दे}ा के सार्वजनिक उद्योगों को बंद करना }ाुरू किया और दे}ा के मजदूरोें के }ाोषण को और तेज करते हुए तेजतर कर दिया। परिणाम स्वरूप आज मजदूरों का जीवन नर्क से भी बदतर होता चला जा रहा है।
इन नीतियों के परिणाम ने कृषि और ग्रामीण अर्थव्यवस्था पर जबरदस्त प्रहार करतेे हुए उन्हें छिन्न-भिन्न कर दिया। कृषि कार्य पूँजी केन्द्रीत होने के कारण एवं बाजार पर बड़े पूँजी के कब्जे ने किसानोें के रीढ़ की हड्डी ही तोड़ डाली और खेती समूल रूप से घाटे का उत्पादन हो गया और वह अनाज उत्पादन एक किसान परिवार के जीवन यापन के लिए भी नाकापफी हो कर रह गया। जिसका नतिजा यह निकला की वह निरक्षर, अ}िाक्षित और अधर््}िाक्षित किसान एवं उसके परिवार के पूरूष सदस्य अपने परिवार की आजीविका चलाने एवं अपने उफपर कृषि से जुड़े होने के कारण हुए कर्जे को अदा करने के लिए बड़े }ाहरों में मेहनत-मजदूरी करने बड़ी संख्या में पहूँचने लगे।
मुख्य रूप से झल्ली मजदूरों में खेती से उफजड़े किसानों एवं उसके परिवार के सदस्यों की ही बहुतायत है। दे}ा के अनेक छोटे बड़े }ाहरों में मेहनत करने के लिए मुख्य रूप से बिहार और उत्तर-प्रदे}ा के पूर्वी इलाके के मजदूर आने लगे । खासकर मेट्रोपोलिटन }ाहरों के व्यापार केन्द्रों में ये उत्तर-प्रदे}ा ओर बिहार के उफजड़े किसान सिर पर सामान ढ़ोने, ठेला खिेचने आदि कार्यों में अकु}ाल श्रम के रूप में काम कर रहे हैं, चाहे मुम्बई हो, दिल्ली हो या अन्य दूसरे बड़े }ाहर। दिल्ली में झल्ली मजदूरों की बड़ी तदाद जो मुख्य रूप से दिल्ली के व्यापारिक केन्द्रों जैसे लाल किला के सामने लाला लाजपत राय का इलेक्ट्रोनिक्स मार्केट, चांदनी चैक के नजदीक भगीरथ पैलेस का बिजली मार्केट और दवाई मार्केट, मोरी गेट-क}मीरी गेट का मोटर, आॅटो और ट्रैक्टर आॅटो पाटर््स मार्केट, सदर बाजार का किराना बाजार, गांध्ी नगर का कपड़ा-वेल्वेट मार्केट आदि जगहों पर मजदूरी करता है। जिनकी संख्या 20 से 25 हजार के लगभग है। इन स्थानों पर बाजार के दूकानदार अपनी अलग-अलग समितियां बनाए हुए हैं जो इस प्रकार हैंः- लाजपत राय मार्केट में सी.आर.ई.एम.ए.;क्रेमाद्ध, भगीरथ पैलेस में बी.ई.टी.ए.;बेटाद्ध, पी.आर.ई.एम.डी.ए.;प्रेम्डाद्ध, और डी.ई.टी.ए.;डेटाद्ध एवं मोरी गेट-क}मीरी गेट मार्केट में दिल्ली मोटर्स ट्रेडर्स एसो}िाएसन, ट्रैक्टर आॅटो पाटर््स मर्चेन्ट्स एसो}िाएसन, बैरिंग आॅटो पार्ट्स एसो}िाएसन, इन तमाम दुकानदार समितियों के उफपर आॅटोमोटीव पार्ट्स मर्चेन्ट्स एसो}िाएसन ;अपमाद्ध है। इस अपमा के द्वारा झल्ली मजदूरों के लिए कई नियम बनाए गए हैं जो इनकी वर्दी, बिल्ला और माल ढुलाई भाड़ा से लेकर कई कायदे तय करते हैं। प्राप्त मोटा-माटी जानकारी के अनुसार 35 से 60 किलोग्राम वजन की ढुलाई के लिए इन्हें 3 से 7 रूपये तक दिया जाता है। इसके और भी कई रूप हैं जो अध्ययन की विषय वस्तु हैं। दुकानदारों की बाजार समितियों द्वारा सिमित संख्या में बिल्ला वितरित तो किया जाता है और समीति यह घोषणा करती है कि सिपर्फ बिल्लाधरी मजदूर से ही माल की ढुलाई कराई जाए। लेकिन दिन व दिन इन बाजारों में झल्ली मजदूरों में }ाामिल होते नये मजदूरों की तदाद के अनुसार ये समितियां कोई नियम नहीं बनाती है। जिसका पफायदा भी इन्हीं बाजार समितियों के दुकादारों को होता है कि ये कम मजदूरी देकर इन झल्ली मजदूरों से काम कराते रहते हैंै। लेकिन पुराने और नये मजदूरों का झगड़ा झल्ली मजदूर आपस में ही करते रहते हैं। इन्हें न तो सरकार अपना मजदूर मानती हे न ही दुकानदारों की बाजार समितियां हीं अपना मजदूर मानती हैं। ये भारत के संविधन के अनुसार मजदूर ही नहीं हैं और न हीं इनके लिए श्रम कानून ही काम कर पाता है। जिसके परिणाम स्वरूप इन्हें किसी भी तरह की कानूनी श्रम सुविध उपलब्ध् नहीं है। इन पर न तो भविष्य निध् िकोष अध्निियम, कर्मचारी राज्य बिमा अध्निियम, ट्रेड यूनियन अध्निियम अथवा सामाजिक सुरक्षा अध्निियम के कानून लागू होते हैं, न हीं इसका इन्हें पफायदा दिया जाता है। उल्टे इन्हें दुकानदार समितियों, ग्राहकों के साथ-साथ पुलिस प्र}ाासन का भी कोपभाजन बनना पड़ता है। इन तमाम परिस्थितियों में इनका श्रमिक जीवन बेहद कठिन स्थितियों में गुजरता है और जीवन स्तर नर्क के समान ही व्यतीत होता है। क्योंकि इतनी कम दर पर मजदूरी की कमाई से इनके रहने की स्थितियां भी नारकिय ही होती हैं। इनके परिवार इन्हीं के कमाई पर आश्रित होते हैं। कुल मिलाकर सरकार द्वारा अनदेखी और दुकानदार समितियों के }ाोषणकारी रूख से इनका आर्थिक, सामाजिक और पारिवारीक जीवन बद से बद्तर होता चला जा रहा है। इन झल्ली मजदूरों की बड़ी आबादी अति पिछड़ी, पिछड़ी और दलित जातियों की हीं है।

Barack Hussein Obama's victory has been so exciting for some columnists that they have started using Obamerica instead of America. Americans, free from Bushdom, expecting democracy from Obama, looking cool, let us see what next. Civil war is finally over, let restoration begin, Thomas L. Friedman points out that the civil war which began in 1861, ended on 4th November, 2008 at midnight and he wishes for 'restoration to begin'. What restoration did he wish? Did the restoration of the Macbethian scoundrels and predators he intend. Did he wish to restore the prestige of those presidents of America who arranged prostitution of slave women in the President's premises and even they used their daughters for this infamy? What does he mean by restoration?
Despite Martin Luther King's crusade and judicial intervention and Civil Right Act of1961 that symbolized a little big leap against the orthodoxy to preserve the continuance of the same order in some sort of veil that lived in the White House. Let Barack Hussein Obama change the very name of the Presidential House and let it be called People's House or the President's House if it is likened by his protons of all inclusiveness as he suggests in his victory speech. As that, the white excludes non-white Americans. It is a racist symbol.
Obama also touched his area of support from the class of workers to non-class differentials in the society. In the very beginning of his victory speech Barack Hussein Obama passes on to emphasis that "America is a place where all things are possible" requires litmus test as less distant as possible.
The victory of Barack Hussein Obama is not the victory of Obama a person or as a party of Democrats as against Republican but a victory of the people, by the people, for the people it appears to be restoration of Lincoln's Democracy in 21st century and that of a legacy from Martin Luther King in Obamaised form is to be witnessed in practice which plans all inclusiveness in the new administration.
It is good to remember the civil war that began at Bull Run, Virginia, on July 1861 entered into a new beginning on the 4th of November 2008 at midnight, and not the end of civil war, I do hold. And I also visualize class struggle to be intensified. It is because extreme of Imperialism by its dénouement requires not only a new engine but differential too. I mean a new system. Can Obama proffer to adopt a new system? He cannot. It is because of his all inclusiveness, a type of envisioning. In his victory speech, Obama proclaimed his victory as of the people, by the people and for the people. Has it not been all abusive for centuries? Even if he declares of the proletariat, by the proletariat and for the proletariat, will be hypocritical one, because proletarian democracy is not of the proletariat, by the proletariat and for the proletariat but it is duty bound to gloat over the demise of capitalism by the proletarian democracy which is also duty bound not only to emancipate the proletariat but the capitalists and imperialists too, which have not only chained the proletariat but themselves too. And definitely it is Marx as a great proletarian is liberating the imperialism from its October 2008 crisis. And this is being done independent of the will of the imperialist system. And it is not the return of Marx; rather utilisation of Marx by the bourgeois mind at the time of its crisis; where as Marxist philosophy of struggle always reaches action through production and reproduction which is the essence of Marxism. If socialist system can produce capitalist development; why not the capitalism system adopt socialist measures to regal out itself from its own created crisis. And if communist parties do not move to match with the higher productive forces, its logical truth will certainly be adopted by its opposite. It is historically, yet to be proved. The question of the present Imperialist state of America is a key question which cannot be changed by Obama administration and his government. He has to negate the misdeeds of Bushism first. Thereafter he has to 'go long', but the question is how 'long'? This question is being debated from all quarters with differentials.
Even the bourgeois writers have opined with facts and figures that the transfer of so much wealth by the Bush administration has been no less than transfer of wealth during the Bolshevik revolution of 1917. Rather we have noticed that is increasing day by day and till date, as much as the number is concern, 19 banks have been nationalized. The difference is to be noted that during the Bolshevik period the wealth was transferred from the rich to the have-nots, in other words to the proletarian state to establish and promote proletarian democracy which failed in 1992 finally. Every body knows that Marx was of the opinion that the revolution will breakout first in the advanced countries. This also is not unknown that Lenin visualized monopoly capitalism or Imperialism as a bridge to pass on to Socialism. And in this new era of Imperialism and the new proletarian revolution, we have formulated that extreme of Imperialism will give birth to new proletarian revolution. But what is happening in America is neither socialist nor new proletarian revolution. And either can't be. As we know despite 8 year of negative teaching of Bush, no third force of the same coin or the modern revolutionary natural communist party of America would have emerged without which no new proletarian revolution would take place. We are happy to note that a Revolutionary Organization of labor, USA is born, we witness that the objective situations are ripe but the subjective forces are yet to be reorganized.

FACT SHEET ON GRAZIANO DISPUTE
This report is based upon an interview of two workers of Graziano Transmissioni, namely Kapil Kumar and Ajay Dwivedi. Kapil belongs to Saharanpur, UP and had joined in 2003 as apprentice, after completing his ITI. He worked 8/9 months under contractor, which was a sham and then was given permanent appointment in 2004. Ajay Dwivedi was employed in 2006.

Graziano Trasmissioni at Noida is subsidiary of a Multinational company based in Italy.

The company had started its operations in Noida, UP, in 2003 with a capital of less than 20 crore rupees, which grew over to more than 240 crores in 2008. This extraordinary accumulation of wealth is the result of super exploitation of workers employed at this establishment.

Lalit Kishore Chaudhary, its CEO has been instrumental in establishment and growth of the company.

Industrial activity in the establishment continued round the clock, initially in two shifts of 12 hrs each, i.e. 6am to 6 pm and then 6 pm to 6 am. Though working hours were limited to 8 hrs and the workers were paid overtime for additional 4 hrs, but the overtime was made compulsory for workers. No weekly off was being given. Those refusing to comply were thrown out.

Initially 350 permanent workers were employed as Operators cum settlers, with 80 Trainees/apprentices. About 500 work under the Labour contractors mostly for the job of packaging.

The very first dispute arose as the employers used to make deductions from the wages on false pretexts.

2/3 Dec 2007- First protest of workers started on the issue of demand for rise in wages and against deduction of wages by the employers on the ground that the entry card was not properly punched. Though it used to happen for technical fault in punching system, while subsequent punchings in the day were duly recorded, yet employers in order to harass the workmen used to deduct the wages, on this false pretext. Workers protested.

Getting wind of workers being organized, striving to form a Union, 3 workers were barred by the employers from entering the premises and one Manoj Kumar was terminated. Management refused to recognize the Union, while authorities at Kanpur kept the application of the workers pending in collusion with employers.

4.12.2007- Protesting against the high handedness of employers, 100 more workers were locked out by pasting a notice of lockout outside the gate.

7.12.2007- A settlement took place between the parties, only to be repudiated by the employers later on. Workers’ protest went on.

AITUC, Trade Union Front of CPI, with whom workers remain affiliated agrees with management to restore normalcy first and then negotiate, which workers reject. After this AITUC abandons workers.

24.1.2008- In face of the struggle of workers, employers are constrained to enter into a written settlement with them, inn presence of DLC, Noida etc. On behalf of workers 5 elected representatives participate, among them –Rajender, Kailash Joshi, Pankesh Sharma, Ram Charan and Mohinder. A homogenous Wage revision is agreed with increment of Rs. 1200/- in current year, Rs. 1000/- in second year and Rs.800/- in third year.

February 2008- However, immediately after this settlement, the employers brought in 400 workers under the local contractors namely Virendra Bhati, Manish and one Bhardwaj.
These contractors with a force of 400 at their disposal, started to bully the workers. Since June 2008, these 400 workers started to reside inside the factory premises. The said contractors had also gathered iron rods, sticks and other weapons etc. inside the premises, to terrorize the workers and obviously to deal with the agitating workers, if need be. Apart from this a whole battalion of armed goons in the name of ‘security’ was also employed under contractor. It became clear thus, that the employers were planning to throw out the permanent workers and want to substitute them with these contract workers.

May 2008- To pick up a dispute and provoke the workers the employers refused to employ 5 worker Trainees/ apprentices and ousted them from the premises on the pretext that they handled the job of ‘settling’ of machine without instructions. It is pointed out that no such written instructions for ‘settling’ job were given to any of the workers. The same was part of ordinary job duty. Workers, thus insisted that then onwards instructions for ‘settling’ jobs be issued in writing. Workers also demanded that the 5 ousted workers be taken on job.

Instead of taking the 5 workers on rolls, the employers suspended 27 more workers. Production Manager Amar Singh Baghel was also ousted on the charge of being in collusion with workers.

The employers had intentionally put off the reverse exhaust fans inside the workshop, which resulted in immense increase in indoor temperature. To ensure that no workman even takes a breath during duty hrs, CCTV cameras were installed, and violators were immediately ousted.

Workers protested the aforesaid unfair labour practices and made complaints to concerned authorities but without any result. Authorities acted hand in hand with the employers.
Workers also demanded 3 shifts of 8 hrs instead of two of 12 hrs each. But as if everything was falling on deaf ears of employers and competent authorities.

30-31/5/2008- A disturbance started on instigation by Virender Bhati, the local muscleman of employers undercover of contractor. A totally false police complaint was made by the employers against the workers for affray, and 30 more of them were locked out. Workers could be released after depositing personal bonds of Rs.1,00,000/- (One Lakh) each, with the SDM NOIDA, which is very unusual and extremely excessive amount.

19.6.2008- Instead of paying any heed to the legitimate grievances of workers, and in order to harass and terrorize the workers, 35 more of them were locked out. With this total 97 workers were ousted, while 192 continued inside out of permanent workers. By this time workers were affiliated with CITU, Trade Union Front of CPI(M) which agreed to the proposal of the employers that first of all normalcy be restored and protest outside the gate be ended, then after a month employers would think to reinstate the workers. Workers did not agree to this and thus CITU also abandoned the workers. However, protest of workers continued.

In the meanwhile workers affiliate to HMS, Trade Union front of Rashtriya Lok Dal, with one Virender Sirohi as their leader.

1.7.2008- Meeting between the employers and HMS takes place in DLC office, in which Sirohi agrees to normal working on 2,3and 4th of July, 2008.

2.7.2008- The employers instead of complying lock out the remaining 192 workmen also. Workers are constrained to resume protest. Dharna in DLC office for 7 days, 3 days before DM office, a march on-foot from Surajpur Chowk to DM office and finally a dharna on Italian embassy is organized, but the entire machine remains totally insensitive towards the cause of workers.

Several times dispute is negotiated at DLC office or the police station, but only to be repudiated by the employers on one or the other pretext or intrigue.
11.7.2008- Settlement is arrived at DLC, Noida Ofifce, in presence of SDM and CO Dadri.

13.7.2008- Workers join at the factory pursuant to settlement and to show their bonafide.
Next meeting is fixed at DLC office on 16.7.2008.

16.7.2008- Out of the 27 suspended workers employers reinstate only 12, while terminate the services of 15 workers. This was apparently a device to divide and crush the workers, one by one.

55 more were notified to be reinstated, but were locked out the very next day on the pretext of coming late at 9 am instead of 6 am.

Employers also obtained an injunction form the Court preventing workers from agitating within 300 mtrs of the Factory premises.

Labour Commissioner came to Ghaziabad from Kanpur. Workers met him and complained about the partial and callous attitude of DLC, Noida. The Commissioner, entrusted the matter to DLC, Ghaziabad.
4.9.2008- Meeting of parties in DLC office, Ghaziabad took place.

16.9.2008- Another meeting in DLC, Ghaziabad office between employers and HMS. None of the elected representatives of the workmen is present in the meeting. It is agreed that workers would tender apology. DLC, Noida directs the workers to tender apology on or before 22.9.2008.

18.9.2008- workers go to tender apology but employers tell that they would call the workers on 22.9.2008. DLC refuses to take the apology in his office.

22.9.2008- As workers gather to tender apology, they are told that two workers at a time would go inside the ‘time office’ to tender apology. Inside the time office, armed security and local goons had already taken their positions. Workers are told to specifically admit in their apology that they had indulged in sabotage and violence. Some workers write it down, but some refused. Anil Sharma, time officer slaps one of the workmen for refusing to write the apology in the desired format. Scuffle starts and the workman is beaten up by the security personnel.

On hearing commotion, workmen present outside enter inside. Unable to prevent the workmen, one of the Manager orders the security and goons present inside to attack the workmen. They attack and securityman fires from his gun at workmen. Several workmen, about 34, are injured in the scuffle.

Jagmohan Sharma, SO, Bisrakh Police Station remained present with force but did not intervene on the behest of employers who had conspired to beat up the workmen. SO has since been suspended for dereliction of duty.

People from both sides were then rounded up by the local police, but those on the side of employers were let to go while workers were kept in custody. Later, it transpired that the CEO of the company had also got one head injury, allegedly in the scuffle, which proved fatal to his life. It is also stated that some of the goons engaged by the employers to deal with the workmen, have double crossed and acting on behest of some rival industrialists have killed the CEO, taking benefit of the chaos perpetuated by the employers.


However, the employers who were desparate to dismiss the regular workmen, got an opportunity to implicate the workmen in the murder and thereby get rid of them. The local Capitalists, corporate media, bureaucracy all avowed enemies of working class, united to defame the workers and implicate them. 63 workers have been implicated for conspiring and participating in the killing of the CEO while 74 other have been implicated for rioting, affray etc.

2.10.2008- Workers staged a sit -in protest at Jantar Mantar against their victimization.

16.10.2008- Another protest in support of workers is held at Jantar Mantar on behest of Labour organizations in Delhi, while a memorandum was submitted to the Minister of Labour.

Hon’ble Sir,


We, the various labour and social organizations, NGOs and individual social activists in and around Delhi, having come together under the banner of ‘Graziano Workers Solidarity Forum’, with all humility represent to you as under:

We want to attract your attention towards the repression being launched against the workers of Graziano Transmissioni at Noida, by the local administration and police in connection to the death of the CEO of the said company. This is apparently being done by the authorities in collusion with the Employers, not only of Graziano but of entire Noida. It seems that the employers there want to settle accounts with the workers, and for this purpose are misusing the machine of the state.

We draw your humble attention to the fact that it is the same authorities who did not pay any heed to the very genuine and legitimate grievances of the workers for more than a year. The prayer of the workers for registration of their Trade Union, which is their statutory right, was kept pending for long. Neither the employers recognized the Union nor the department of labour permitted it to be registered.

While the State authorities connived in depriving the workers of their minimum and modest rights, the employers went on exploiting the workers without challenge. Graziano Transmissioni could thus earn super profits. The capital of 20 crore invested by this company in 2004 grew over to 240 crore in 2008. This could happen only through super exploitation of the labour of poor workers. All peaceful protests of workers had fallen on deaf ears of the authorities. The employers, however, did everything in their control to crush the protests of workers, from suspension, lockout to outright terminations.

The unfortunate incident of 22nd September, cannot be made a tool to crush the workers further. The false charge being mischievously attributed by the police to the workers, of alleged conspiracy to harm the CEO, is beyond comprehension. There is no history of workers in Graziano of resorting to violence, much less a conspiracy. Moreover, the workers could not have expected any gain through such act. It is also underlined that even the wife of the CEO Smt. Ratna, who is a well educated lady, has herself claimed that the killing of the CEO is the result of conspiracy by the rival business groups, form whom the CEO, Mr.L.K. Chaudhary himself had been expressing apprehension, immediately before his elimination.

We would also like to point out here, that according to our knowledge the dispute between the workers and management had already settled amicably and thus there was hardly any occasion for the workers to enter into a tussle. Yet another side of the matter is that it has appeared more than once in media that some rival business factions may be behind the elimination of CEO. Be that as it may, the charge against workers of conspiracy to kill CEO is not only misplaced but mischievous also.

We apprehend, on the contrary, a conspiracy on the part of employers in Noida, hand in hand with the police, to drown the peaceful and legitimate struggle of the workers in violence and blood and thereby vitiate the industrial atmosphere in Noida for the time to come. It is not the repression upon the workers, but a process of conciliation among the parties, which may help to restore the congenial atmosphere in Noida.

The Government cannot permit itself to be used as a tool at the behest of those who have the might of millions in their hands and cannot be turned into a vehicle of vested interests against the toiling workers. It goes without mention that Noida and its vicinity, Delhi included, is saturated with these toilers. The apparent bias of state authorities against the workers, with an indifference towards their sufferings in the past and present, would result in perpetuating an environment of unwarranted hostility in the entire region.


We, therefore humbly present the following demands before Your kindself:


1. Arrested workers be released immediately and the false charges imposed upon them be withdrawn
.
2. Suspended and dismissed workers be reinstated in the job.

3. Adequate compensation be given to the victimized workers.

Graziano Workers' Solidarity Forum
Representatives of people from different walks of life met on 28.9.2008 in Delhi, in support of the cause of ongoing struggle of workers at Graziano Transmissioni in Noida. The representatives condemned the violence perpetuated by the Management through armed goons in the name of security guards, of which more than 50 workers have become victim and several have received grievous injuries.
The representatives expressed serious concern over the bias shown by the corporate media, run by the power of millions, against the working class. Support was declared for the cause of workers of Graziano, who are being savagely exploited at the hands of the MNC- Graziano. It was underlined that not only the capitalists and their media, but the Government has also joined hands to crush the legitimate struggle of the workers.
A call was thus issued to workers of Delhi and around to join the forces with workers of Graziano, to demonstrate class solidarity. It was decided not to permit the capitalists, their media and their Govt. to isolate the struggling workers of Graziano and crush their spirit.
With this in mind, a 'Graziano Workers' Solidarity Forum' has been formed and following decisions were taken to render immediate support to the workers of Graziano-
1.Constitute a fact finding team, 2.Provide legal and financial aid, 3.To provide wider dissemination of truth behind the case, among the working class and the general people
The forum demands that: 1. The Managements of Industry be barred by law from raising private armies of goondas, under the garb of security. 2. All more than 50 workers who had suffered injuries at the hands of goondas/ security of the Management should be adequately compensated for Rs. Two Lakh each. 3. The Managers of Factory who perpetuated the violence be immediately arrested. 4. All 136 arrested workers be released forthwith. 5. Action be taken against the labour and other authorities who in connivance with management of Graziano failed to take timely action in the matter. 6. A jury of citizens, with workers representatives be formed to investigate and hear the case of workers of Graziano. 7. Families of workers be compensated for harassment and exploitation of workers, suffered at the hands of managers and police.

Americans, free from Bushdom, expecting democracy from Obama, looking cool, let us see what next. Civil war is finally over, let restoration begin, Thomas L. Friedman points out that the civil war which began in 1861, ended on 4th November, 2008 at midnight and he wishes for 'restoration to begin'. What restoration did he wish? Did the restoration of the Macbethian scoundrels and predators he intend. Did he wish to restore the prestige of those presidents of America who arranged prostitution of slave women in the President's premises and even they used their daughters for this infamy? What does he mean by restoration?
Despite Martin Luther King's crusade and judicial intervention and Civil Right Act of1961 that symbolized a little big leap against the orthodoxy to preserve the continuance of the same order in some sort of veil that lived in the White House. Let Barack Hussein Obama change the very name of the Presidential House and let it be called People's House or the President's House if it is likened by his protons of all inclusiveness as he suggests in his victory speech. As that, the white excludes non-white Americans. It is a racist symbol.
Obama also touched his area of support from the class of workers to non-class differentials in the society. In the very beginning of his victory speech Barack Hussein Obama passes on to emphasis that "America is a place where all things are possible" requires litmus test as less distant as possible.
The victory of Barack Hussein Obama is not the victory of Obama a person or as a party of Democrats as against Republican but a victory of the people, by the people, for the people it appears to be restoration of Lincoln's Democracy in 21st century and that of a legacy from Martin Luther King in Obamaised form is to be witnessed in practice which plans all inclusiveness in the new administration.
It is good to remember the civil war that began at Bull Run, Virginia, on July 1861 entered into a new beginning on the 4th of November 2008 at midnight, and not the end of civil war, I do hold. And I also visualize class struggle to be intensified. It is because extreme of Imperialism by its dénouement requires not only a new engine but differential too. I mean a new system. Can Obama proffer to adopt a new system? He cannot. It is because of his all inclusiveness, a type of envisioning. In his victory speech, Obama proclaimed his victory as of the people, by the people and for the people. Has it not been all abusive for centuries? And definitely it is Marx as a great proletarian is liberating the imperialism from its October 2008 crisis. And this is being done independent of the will of the imperialist system. And it is not the return of Marx; rather utilisation of Marx by the bourgeois mind at the time of its crisis; where as Marxist philosophy of struggle always reaches action through production and reproduction which is the essence of Marxism. If socialist system can produce capitalist development; why not the capitalism system adopt socialist measures to regal out itself from its own created crisis. And if communist parties do not move to match with the higher productive forces, its logical truth will certainly be adopted by its opposite. It is historically, yet to be proved. The question of the present Imperialist state of America is a key question which cannot be changed by Obama administration and his government. He has to negate the misdeeds of Bushism first. Thereafter he has to 'go long', but the question is how 'long'? This question is being debated from all quarters with differentials.
